Empowering General Guidance
1.1 These General Guidelines serve as the authoritative framework, delineating the rights and obligations among visitors (referred to as “V”), customer-tennis players (referred to as “CTP”), customer-service providers (referred to as “CSP”), and Tennis Visionary, LLC (referred to as “Tennis Visionary”), concerning the use of its website and services.
1.2 In addition to this Guidance, the rights and obligations outlined in the preceding article are regulated by the Privacy Policy, the Terms and Conditions, the Code of Engagement and the General and the Individual Services Purchase Agreement to which we refer.
Visitor (V)
2.1 V utilize and explore the website for their individual needs.
2.2 V are prohibited, without explicit written permission from Tennis Visionary, from duplicating any part of the website, replicating, or employing, in any manner, proprietary models or systems created by Tennis Visionary, whether patented or not (e.g., PTP Assessment, TPT Tester, TTPP Tournament Game). Violation of this guideline holds the offending party liable for any damage caused to Tennis Visionary.
Customer-Tennis Player (CTP)
3.1 CTP is a registered customer of Tennis Visionary, a member of the Tennis Visionary DTE Community, and an acceptor of the Tennis Visionary Code of Engagement, having entered into a Service Purchase Agreement with Tennis Visionary.
3.2 CTPs, with less than one year of tenure, have access to the Tennis Visionary portal with all complimentary benefits, excluding the continuous monitoring-mentoring service reserved exclusively for CTPs with over one year of customer status.
3.3 CTPs, with over one year of customer status, enjoy access to the Tennis Visionary portal with all complimentary benefits, including the continuous monitoring-mentoring service reserved exclusively for those with customer status exceeding one year.
3.4 The pricing of purchased services for CTPs is determined based on the complexity of the requested/provided service, including the type of service (full, partial, individual) and the required hours, contingent upon the player’s age/phase/stage of development.
3.5 To prevent circumvention of Tennis Visionary by customers, CTPs must promptly notify Tennis Visionary of any service agreement entered with SPC, including all service payments made to them. Notifications must be submitted through the Tennis Visionary portal via email or UPS-certified mail.
3.6 Violation of this rule fulfills a legal prerequisite outlined in these Guidelines and the Service Purchase Agreement, leading to the termination of agreements and the loss of CTP status.
3.7 Termination of the agreement or loss of CTP status does not absolve CTP’s obligation to remit payment for previously received services.
3.8 Before litigation, disputes between parties will be resolved through Tennis Visionary Arbitration involving two Judges, with each party providing one, and the Chair Judge appointed by the manager of Tennis Visionary Network of Qualified Service Providers. Decisions by Arbitration hold the authority of an agreement and are enforceable in court.
Customer-Service Provider (CSP)
4.1 CSP is a registered customer of Tennis Visionary, a member of the Tennis Visionary DTE Community, and an acceptor of the Tennis Visionary Code of Engagement, having entered into a Service Purchase Agreement with Tennis Visionary.
4.2 CSPs, with less than one year as business partners, have access to the Tennis Visionary portal with all complimentary benefits, excluding “service priority” for obtaining CTP leads, reserved exclusively for CSPs with over one year of customer status.
4.3 CSPs, with over one year as loyal business partners, have access to the Tennis Visionary portal with all complimentary benefits, including “service priority” for obtaining CTP leads, reserved exclusively for CSPs with over one year of customer status.
4.4 The pricing for purchased services charged to CSPs for the provided service (CTP leads) is determined as a commission of up to 8% of the amount that CSP charges to CTP for the service provided to them.
4.5 To prevent circumvention of Tennis Visionary by customers and clients, CSPs must immediately notify Tennis Visionary of any service agreement entered with CTP, including all service payments made to CSP, through the Tennis Visionary portal via email or UPS-certified mail.
4.6 Violation of this rule fulfills legal prerequisites outlined in these Guidelines and the Service Purchase Agreement, leading to the termination of agreements and the loss of CSP status.
4.7 Termination of the contract or loss of CSP status does not absolve CSP’s obligation to remit payment for previously received services.

Change of this Guideline
5.1 Tennis Visionary reserves the right to modify these Guidelines at its sole discretion. Users will be promptly notified of any material changes to these Guidelines. Users understand and agree that they will be deemed to have accepted the updated Guidelines if they continue to use the Service after the new Guidelines become effective.
